End User License Agreement (EULA) for MediPort

This End User License Agreement ("EULA") is a legal agreement between you ("User") and MediPort, owned and operated by Aarya Ningaraddiyavar and Nandan Kamaraddi, regarding the use of the MediPort website (www.mediport.live) and its associated services. By using the website or services provided by MediPort, you agree to the terms outlined in this EULA.

1. Acceptance of Terms

By accessing, browsing, or using any part of the MediPort website or services, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you do not agree to all of the terms and conditions of this agreement, you are prohibited from using the website or any services provided by MediPort.

2. Grant of License

MediPort grants you a limited, non-exclusive, non-transferable, and revocable license to access and use its website and services solely for your personal, non-commercial purposes. This license is subject to the terms and conditions set forth in this EULA.

3. Ownership of Content

All content, data, information, trademarks, logos, and intellectual property available on the MediPort website are owned by or licensed to MediPort. You may not reproduce, distribute, modify, or create derivative works based on any content from the website without explicit written consent from MediPort.

4. Prohibited Uses

You agree not to use the website or services for any illegal or unauthorized purpose, including but not limited to:

  • Violating any applicable laws or regulations

  • Attempting to gain unauthorized access to the website’s systems

  • Transmitting any malware, viruses, or harmful code

  • Engaging in any form of data scraping, data mining, or similar activities

7. Disclaimer of Warranties

MediPort disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MediPort does not guarantee that the website will be uninterrupted, error-free, or free from viruses or other harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MediPort, its owners, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use or inability to use the website, services, or products purchased through the website. This includes, without limitation, damages for loss of profits, data, or goodwill.

9. Indemnification

You agree to indemnify, defend, and hold harmless MediPort, its owners, affiliates, and service providers from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your violation of this EULA

  • Your use of the website or services

  • Any claims related to the misuse of medications or services offered through MediPort

10. Termination

MediPort reserves the right to terminate or suspend your access to the website or services at any time and without notice, for any reason, including but not limited to your breach of this EULA. Upon termination, all provisions of this EULA that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability) will remain in effect.

11. Changes to this Agreement

MediPort reserves the right to modify this EULA at any time. Any changes will be posted on the MediPort website and will take effect upon posting. Your continued use of the website following the posting of any changes to the EULA will constitute acceptance of those changes.

12. Governing Law

This EULA will be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under this agreement will be subject to the exclusive jurisdiction of the courts in Karnataka, India.

13. Severability

If any provision of this EULA is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
