Terms and Conditions for MediPort
1. Ownership and Operation
MediPort is an independently operated community-based business, owned by Aarya Ningaraddiyavar and Nandan Kamaraddi. While our customers are members of the community, this business operates solely under the direction of its owners. Members of the community do not have any control over the business decisions, finances, profits, or assets. This business is operated out of Karnataka, India.
2. Community-Driven Model
MediPort exists as a service to provide affordable medication to the community. Any advertisements or promotional activities are solely focused on expanding this community initiative and reaching more people in need of affordable healthcare solutions. Our community members are encouraged to spread awareness about our mission, though they do not have any legal or operational rights over the business.
3. Medicine Sourcing
MediPort does not produce any of the medicines sold or exported. The medications are sourced exclusively from reputed pharmaceutical companies in India, which comply with both Indian Drug Policy regulations and are US FDA-approved. All medicines supplied through MediPort adhere to Indian government safety standards and are manufactured in licensed and certified facilities.
4. Liability for Medication Quality and Effectiveness
We strive to work with reputable pharmaceutical companies that follow stringent quality control measures, but MediPort is not responsible for the quality, effectiveness, or any defects in the medicines provided. Any issues related to drug quality must be taken up directly with the pharmaceutical company that manufactured the medication.
5. Responsibility of Use
MediPort is not liable for any misuse, abuse, or overdose of the medicines sold. By purchasing from MediPort, the consumer confirms that they are fully aware of the medication being ordered and that they will use it responsibly. Consumers are required to consult with a qualified doctor to verify that the prescribed medication is safe for their consumption.
6. Prescription Requirement
All medicines sold through MediPort require a valid Indian prescription, which must be provided by a licensed Indian doctor. The consumer will receive a legitimate prescription and bill from an Indian pharmacy as part of the transaction. This prescription must be used solely for personal use and not for any resale or distribution purposes.
7. US FDA Regulations Compliance
Under US FDA guidelines, medicines ordered from MediPort must not exceed a three-month supply for personal use. To comply with this requirement, MediPort offers a subscription-based model, allowing customers to reorder medications in compliance with these regulations.
8. Personal Use and Resale
All medicines ordered from MediPort are strictly for personal consumption only. If a consumer attempts to retail or redistribute the medicines and is caught, MediPort will not be held liable. The customer bears full responsibility for any legal consequences that may arise from such actions.
9. Shipping and Delivery
While MediPort ensures that all orders are dispatched through reliable shipping partners, we are not liable for any damage, loss, or delays that occur during shipping. The consumer assumes full responsibility for the shipment once the order has been handed over to the carrier.
10. Website Ownership
The website www.mediport.live is owned by MediPort. This domain has been leased from GoDaddy.com, and any activities related to the website, including operations, updates, and customer interactions, are managed solely by the owners.
11. Data Privacy
We value the privacy of our consumers. All personal data provided by the consumers is collected strictly for business purposes and will not be shared with any third parties under any circumstances. The data is securely stored on Wix servers, which follow international standards for data protection.
12. Storage and Handling of Medicines
As a distributor, MediPort does not handle the storage or manufacturing of the medicines. Consumers are responsible for verifying the contents and ensuring that the medication is appropriate for their use, as MediPort holds no knowledge of storage conditions or manufacturing details beyond what is provided by the pharmaceutical companies. Consumers should consult a licensed physician for any concerns about the safety, quality, or usage of the medication.
13. Legal Compliance
MediPort operates under the laws of India, and our business complies with all relevant Indian Drug Policy guidelines. While we work to ensure that our medicines also meet US FDA approval, consumers must be aware that legal regulations regarding the import of pharmaceuticals differ between countries. It is the consumer’s responsibility to ensure that the medicines being imported comply with the regulations in their own country.
14. Limitation of Liability
MediPort and the prescribing Indian doctors are not liable for any adverse reactions, side effects, or health complications that may arise from the consumption of the medication. By purchasing from MediPort, the consumer agrees that they are solely responsible for their own health and any decisions made regarding the use of the medication.
